Welcome to Bright Futures. By using our services, you agree to the following terms and conditions.
These terms govern the use of our SEND (Special Educational Needs and Disabilities) advocacy services, including assistance with EHCP (Education, Health, and Care Plan) applications and general SEND support services.
Please read these terms carefully before engaging with our services.

2. Services Provided
We offer the following services:
• EHCP Support: Assistance with the process of applying for, reviewing, and managing Education, Health, and Care Plans.
• SEND Advocacy: Representation and advocacy for individuals navigating the SEND system, including communication with local authorities and educational institutions.

3. Eligibility
To use our services, you must be either the legal guardian, parent, or the individual requiring SEND advocacy support. You agree to provide accurate and truthful information when engaging with our services.

4. Fees and Payment
• Services are subject to specific fees, which will be clearly communicated at the time of engagement.
• A complimentary 15-minute call is included to review the draft document, discuss any amendments, and ensure satisfaction before payment is made.
• The balance must be paid in full before any work is released to the client.
• Invoices not settled on time will incur a 10% late payment fee.
• Bright Futures reserves the right to suspend or terminate services if payment is not received in accordance with the agreed terms.
• All payments must be made using the approved payment methods provided.

5. Confidentiality and Data Protection
We respect your privacy and confidentiality. Any personal data provided to us will be processed in accordance with relevant data protection laws, including the UK GDPR. Bright Futures is registered with the ICO.
• We will only collect, use, and store personal data for the purposes of delivering our services.
• We will not share any personal information without your explicit consent unless required by law or regulation.
• You are responsible for ensuring that any information you provide to us is accurate and up to date.

6. Responsibilities of the Client
• You agree to cooperate fully with us and provide all necessary documentation, information, and access required for the proper delivery of our services.
• You are responsible for ensuring that all submitted materials are accurate and complete, and we will not be liable for any delays or errors caused by incomplete or inaccurate information.

7. Our Responsibilities
• We will provide services with due care, skill, and diligence.
• While we will make every effort to support your EHCP and SEND applications, we cannot guarantee outcomes as these are subject to external factors, including decisions made by local authorities, education providers and health professionals.
• We will keep you informed of the progress of your application and advocate on your behalf as effectively as possible.
8. Limitation of Liability
• Our liability is limited to the total amount paid by you for the service in question.
• We are not liable for any indirect, incidental or consequential damages arising from our services.
• We do not guarantee any specific outcome and the final decision on matters related to EHCPs or other SEND-related matters lies with the relevant authorities.

8. Cancellations and Refunds
• Cancellations made more than 48 hours in advance of the scheduled appointment will be processed without any penalty or charge.
• Cancellations made less than 48 hours before the scheduled appointment will be subject to a fee of 50% of the total service cost.
• In the event that Bright Futures cancels your appointment, we will either reschedule the appointment at the next convenient time for you or provide a full refund.

9. Termination of Services
• Either party may terminate the agreement at any time with written notice.
• We reserve the right to terminate services immediately if there is a breach of these terms, including non-payment or failure to cooperate fully.
• If we terminate the services, you will only be liable for the payment of services rendered up to the point of termination.

10. Disclaimer
• For the avoidance of doubt, Bright Futures staff do not hold any medical qualifications and do not offer legal advice. Our services are focused solely on providing advocacy and support for SEND-related matters, including assistance with EHCP applications and general SEND support. We do not provide medical, therapeutic, or legal services, and any decisions requiring medical or legal expertise should be directed to qualified professionals in those fields.

11. Amendments
We reserve the right to amend these Terms and Conditions at any time. Any amendments will be communicated to you, and your continued use of our services after such amendments will constitute your acceptance of the updated terms.
